These terms govern your use of AbsCon, a construction and mechanical estimating application operated by Absolute Contracting LLC. By creating an account or continuing to use the service, you agree to these terms.

1. The service

AbsCon turns job parameters into material takeoffs, tool lists, estimates, proposals, submittals, and preliminary concept drawings. You are contracting with Absolute Contracting LLC. You must be of legal age and, if you use AbsCon for a business, have authority to bind that business.

2. Estimates are not guarantees

AbsCon produces preliminary estimates and concept drawings from the information you provide. Quantities, prices, and layouts must be field-verified before purchasing, fabrication, permit submission, or bid commitment. Drawings are marked preliminary and are not for construction. You are responsible for confirming dimensions, codes, and site conditions, and for using licensed professionals where required.

3. Acceptable use

You must not misuse the service, including: unlawful use; fraud or spam; infringing intellectual property; interfering with security (malware, probing, scraping); reverse engineering; reselling or redistributing the service; or circumventing plan limits.

4. Your account and content

Keep your credentials confidential; you are responsible for activity under your account and for providing accurate information. You retain ownership of the project data you enter. You grant us a limited license to host and process that data solely to provide the service.

5. Intellectual property

Absolute Contracting LLC retains ownership of AbsCon, including its software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan.

6. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically until canceled; you can cancel at any time and keep access until the end of the paid period.

7. Service level and warranties

We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid in the twelve months before the claim, and we are not liable for indirect, consequential, or special damages (including lost profits, data, or goodwill). Nothing in these terms excludes liability for fraud, death, or personal injury where the law does not allow it.

9. Suspension and termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. When your access ends, you may request an export of your project data for a reasonable window before it is deleted.

10. General

These terms are governed by the laws of the Commonwealth of Pennsylvania, USA. We may assign these terms in connection with a merger or acquisition; you may not assign them without our consent. We are not liable for delays caused by events beyond our reasonable control.
